Raphaelson and Levine successfully argued that a recent court of appeals decision holding that objects that fall from the same level as a worker can be considered a violation of labor law section 240. This section commonly known as the " ladder law" has been extended to include any injury related to gravity regardless of the position of the worker or the equipment that causes the injury.
“In addition to labor law section 240, counsel were also able to successfully argue that Section 241 (6) applied." Partner Andrew Levine said, “Counsel held the defendants liable for an industrial code violation that required a safe work area free from tripping & other hazards.”
